Each answer distinguishes the official rule from the facts and documents needed for an individual assessment.
What is the Portuguese D1 visa?
D1 is shorthand for the residence visa for subordinate employment. Its legal basis is Article 59 of Law 23/2007, and the applicant generally needs a genuine Portuguese employment relationship supported by the appropriate employer-side evidence.
Can I apply with a promise of employment rather than a signed contract?
The law and gov.pt list a qualifying promise of a work contract. However, an ambiguous email or informal invitation is not automatically equivalent to a substantive contractual promise; check its terms and signature evidence against the competent post.
Do I need to find an employer before applying?
For an ordinary D1 case, yes: the route is employer-backed, not a mechanism for entering Portugal first to search for a job. Employment contracts, promises or relevant individualised employer interest are integral to the legal framework.
Is D1 the same as Portugal’s job-seeker visa?
No. D1 is an employment residence visa. The older job-seeker category was discontinued under immigration-law changes, and any replacement highly qualified job-search scheme must be checked for operational regulations and consular availability rather than assumed open.
Is the minimum salary €920 in 2026?
€920 is the 2026 mainland statutory guaranteed monthly wage. It is not a universal proof-of-means threshold, a guarantee that a proposed contract is lawful or an acceptable offer across all regions, part-time arrangements and collective bargaining agreements.
Can an overseas employer sponsor a D1 application?
D1 ordinarily concerns employment performed under the qualifying Portuguese employment framework. A foreign employer with no proper Portuguese employment structure may need a different legal assessment, potentially involving remote-work or other routes.
Is an IEFP declaration always required?
The gov.pt D1 service checklist expressly identifies an IEFP declaration. The applicable scope and mechanism should be verified with the competent post and employer, especially if a specialist exemption, labour mechanism or updated instruction applies.
Can a company ask me to pay a private fee to receive a job offer?
Treat requests for money in exchange for a purported job or visa approval as a significant fraud signal. Verify the company and recruitment process. Public immigration and consular charges should be distinguished from lawful professional advisory fees.
Does a contract guarantee visa approval?
No. Authorities also assess general visa requirements, identity, criminal record, documentation, lawful residence in the consular jurisdiction and any admissibility concerns.
Must the position be on a shortage occupation list?
Do not assume a single current shortage list controls every D1 application. The statutory and IEFP framework should be checked for the actual employment offer and competent consular instructions.
What if I am a nurse, architect or another regulated professional?
The D1 government checklist requires proof of entitlement to exercise a regulated profession where applicable. Professional-order recognition, qualifications and licensing may need to be addressed separately from the immigration application.
Can I apply at a Portuguese consulate outside my country of citizenship?
Possibly where the post is competent for your lawful residence, but not merely because appointments are easier. Verify jurisdiction and what proof of residence is required.
What documents normally accompany the work offer?
The government lists a form, passport, photos, travel medical insurance, criminal-record proof, accommodation, means of subsistence, qualifying employer documents, IEFP declaration and profession-specific evidence where relevant. Check the actual post’s current list.
How much is the consular visa fee?
The official gov.pt D1 service lists €90, but the actual payable amount can vary with exemptions, service provider charges and current tariff changes. AIMA card issuance carries separate administrative fees.
Does the stated 60-day timeline mean I will have my card in two months?
No. The stated period concerns the government visa service, not guaranteed appointment availability or later residence-permit issuance. Document requests and AIMA scheduling may extend the overall process.
How long is the entry residence visa usually valid?
The Ministry of Foreign Affairs’ national visa information describes residence visas as generally valid for four months and two entries, to support the subsequent residence-permit step.
What must I bring to the AIMA stage?
AIMA Article 88(1) identifies the valid passport and visa, sworn employer declaration confirming the employment relationship and residence-address declaration with supporting documents as applicable. Always check the current complete checklist.
How long does the first work residence card last?
AIMA’s work-residence guidance describes a standard initial temporary permit of two years followed by renewable successive three-year periods, subject to eligibility and any changes to the law.
Can I switch to a new employer after my card is issued?
Law 62/2026 added Article 88(8), allowing a residence permit holder to change employer by communicating this to AIMA without a new card solely for the change. This should not be confused with the rules governing a pending initial application.
Can I freelance on a D1 work residence permit?
AIMA indicates that switching the legal nature of professional activity may require the appropriate residence-title or status procedure; do not assume every independent activity is automatically covered by an employment permit. Check the current legal mechanism.
Can my spouse and minor children come?
Potentially, under applicable accompanying-family or reunification routes. Relationship, lawful residence, means and housing rules must be assessed separately. Law 61/2025 introduced waiting rules for later family reunification with important exceptions.
Does every spouse have to wait two years?
No blanket statement is accurate. Article 98 includes a general two-year period, a 15-month pathway for some qualifying spouses and exemptions involving particular dependants or household circumstances. Simultaneous accompanying-family visas are a separate topic.
Can I enter as a tourist and obtain D1 through Manifestação de Interesse?
Do not plan a new case on that assumption. AIMA says the old Article 88(2) route without a residence visa was revoked for newly initiated cases from 4 June 2024; only transitional cases begun by the stated cut-off are treated separately.
What happens if the employer withdraws the offer before approval?
Notify the relevant advisers and authority as appropriate. Withdrawal can undermine the eligibility evidence and may require a fresh qualifying offer or a revised application strategy. Concealing the change would create avoidable compliance risk.
Does having a D1 card let me work anywhere in the EU?
No. Portuguese residence does not automatically provide general employment authorisation in other EU member states. EU mobility rules and any relevant permit categories require separate assessment.
What does Portugal Path review before recommending D1?
Our proposed process checks contract legitimacy, employer and IEFP evidence, visa category, profession regulation, document legalisation, family pathways and AIMA handoff readiness. Only the public authorities can decide approval.
Can I use a recruitment agency instead of direct employment with a Portuguese company?
The legal employing entity, location and nature of the employment relationship are decisive. Agency arrangements require scrutiny of which organisation is the employer, who owes wage and social-security obligations, and whether the documents meet the competent consular checklist.
Can an employer promise that my D1 visa will be approved?
No. The employer can provide relevant contracts and declarations, but the consular authority decides the visa application and AIMA assesses the later residence permit. Any recruitment or advisory guarantee should be treated as a red flag.
Does the D1 visa let me start work before entry conditions are met?
A residence visa is not a substitute for complying with entry, employment, tax and social-security rules. Review the start date and employer onboarding steps with the competent authorities and qualified advisers before commencing work.
