Portugal Startup Visa 2026: IAPMEI & Incubator Requirements

This is an innovation-and-incubation programme, not a generic company formation package. Evidence of technological value, market potential and founder eligibility is essential.

Decision intelligence

The right route is the first safeguard.

A specialist, incubator-supported immigration programme under Article 60(2)(c) and Article 89(4)—not a generic company-registration shortcut or an automatic incubator acceptance. Eligibility starts with real facts and traceable evidence, not a guaranteed-approval sales pitch.

Legal basis and operational detail

What a credible application must demonstrate.

The questions below connect statutory eligibility with the practical documents, actors and decisions that make or break an application.

01 / LEGAL & EVIDENCE REVIEW

What the official StartUP Visa actually does

IAPMEI runs a programme for non-EU entrepreneurial projects with innovation and internationalisation prospects, relying on a certified incubator to host and support founders. The route combines programme approval, an incubation contract, the consular residence-visa application and a separate residence-permit decision by AIMA. Incubator interest is not itself immigration permission, and a company incorporated in Portugal without this process is not automatically a StartUP Visa project.

02 / LEGAL & EVIDENCE REVIEW

Statutory architecture: Article 60 versus Article 89

Article 60(2)(c) connects the qualifying entrepreneur visa to investment in an innovative business integrated in a certified incubator, while Article 89(4) addresses the subsequent residence-permit framework. Despacho Normativo 4/2018 sets programme conditions; Portaria 344/2017, as amended, governs incubators. The ordinary D2 independent-professional or entrepreneur route is separate and must be evaluated on its own merits.

03 / LEGAL & EVIDENCE REVIEW

2026 founder subsistence: €6,445.56 is not company investment

Article 5 requires each founder to document own personal means equal to twelve times the Indexante dos Apoios Sociais (IAS). IAPMEI reports a 2026 IAS of €537.13: twelve times that amount is €6,445.56. The evidence is a bank document; access, ownership, currency and availability must be credible. This is a founder subsistence criterion, not the project budget, programme fee, guaranteed total cost or an exemption from later consular means requirements.

04 / LEGAL & EVIDENCE REVIEW

Innovation and the €325,000 economic-potential criterion

The official IAPMEI guidance evaluates a technology- and knowledge-oriented project capable of developing innovative goods or services, internationalisation, skilled employment and market scale. The legal programme tests the potential to exceed €325,000 in annual turnover and/or assets within the stated five-year horizon after incubation begins. It does not require a founder to deposit €325,000 at the application stage. A grounded forecast must connect pricing, distribution, traction, customer validation and operational capacity.

05 / LEGAL & EVIDENCE REVIEW

Eligibility: personal profile and residency status

The programme rules require applicants to be at least 18, have no disqualifying criminal record, satisfy applicable tax and social-security obligations, demonstrate the required funds, and not have permanent residence within Schengen, among other criteria. Assess whether the applicant is starting a new venture or relocating an existing business; those fact patterns carry different evidential requirements. The general marketing phrase “entrepreneurs worldwide” is not a substitute for the exact statutory restrictions.

06 / LEGAL & EVIDENCE REVIEW

Team applications: a maximum of five founders

The regulation permits a maximum of five entrepreneurs in one application. Each proposed founder should play an indispensable role and satisfy the personal eligibility conditions. The founder list should reflect product development, commercial execution and governance rather than being expanded simply to obtain immigration benefits. Co-founder contracts, shares, roles and actual availability should align with the pitch and incorporation plan.

07 / LEGAL & EVIDENCE REVIEW

Existing foreign startups face additional tests

The 2018 programme rules have specific conditions for relocating an existing company: established fewer than four years in the country of origin; proposed activity in Portugal; potential for at least five jobs within 24 months, beyond the founders; a qualifying executive position and/or at least 10% share or voting rights; and positive net equity in the prior financial year. These are branch-specific provisions, not blanket requirements for every brand-new startup. Apply the correct version of the programme rules to the actual company history.

08 / LEGAL & EVIDENCE REVIEW

Certified incubators: fit before signatures

Choose incubators from IAPMEI’s certified programme list, assessing sector match, location, physical incubation expectations, management capability, support services and fee structure. IAPMEI announced 94 certified incubators in its January 2026 cycle, but the active list may change. A general coworking desk, an informal mentor or an incubator certified under another programme is not proof of Startup Visa eligibility.

09 / LEGAL & EVIDENCE REVIEW

From incubator interest to binding incubation contract

The founder first seeks formal expressions of interest from eligible incubators through the programme platform. IAPMEI reviews the application; after a positive decision, a written incubation contract must be concluded within the applicable programme deadline and registered. The IAPMEI declaration certifying the contract is critical to the immigration phase. An email saying “we like the idea” cannot replace those formal stages.

10 / LEGAL & EVIDENCE REVIEW

Application language, evidence and business narrative

The published rules require an electronic application in Portuguese and English, including motivation, applicant documentation, project presentation and incubator interest. Build a coherent investment thesis: problem and customer segment, defensible innovation, IP ownership, competitive alternatives, product development milestones, sales channels, recruiting plan and conservative financial scenarios. A deck without evidence of implementation is weak; a feasibility file should withstand commercial, financial and immigration scrutiny.

11 / LEGAL & EVIDENCE REVIEW

Decision timelines are stage-specific

The programme rules refer to an IAPMEI decision in up to 30 working days from the programme submission and a period of 40 working days for concluding an incubation contract after approval, subject to their procedural conditions. They are not promises about incubator feedback, consular appointments, visa issuance or AIMA card production. Design a milestone plan and cash runway that tolerate delays and follow-ups.

12 / LEGAL & EVIDENCE REVIEW

Consular visa: programme approval is not a visa

Once the prescribed programme steps and contract are complete, the applicant follows the competent Portuguese consulate’s residence-visa requirements, including identity, background, travel/insurance, living arrangements and IAPMEI declaration. The local post governs jurisdiction, booking, translations and authentication. Incubator endorsement does not remove the sovereign immigration decision, and old instructions mentioning SEF should be read against AIMA’s current institutional role.

13 / LEGAL & EVIDENCE REVIEW

AIMA handoff under Article 89(4)

AIMA publishes the entrepreneur permit route with passport, suitably authenticated criminal records, sworn address declaration and property/landlord evidence, IAPMEI confirmation of eligible innovative incubation, plus tax and social security registrations when applicable. AIMA describes an initial two-year permit, renewable for successive three-year periods, subject to governing rules and continued eligibility. Do not confuse a four-month residence entry visa with the card itself.

14 / LEGAL & EVIDENCE REVIEW

Incubation contract and continuing compliance

An incubation agreement sets the incubator’s services, responsibilities, fees, monitoring, project plan and obligations of the entrepreneur. The published programme rules specify a 12-month agreement renewable for similar periods by agreement, with monitoring and progress reporting. Performance, reporting, changes to the founding team and the continued certified status of the incubator can matter well after immigration entry. A startup is an ongoing operational commitment, not a one-off visa document.

15 / LEGAL & EVIDENCE REVIEW

Founder ownership, intellectual property and capitalisation

A credible file explains who owns the IP, who holds shares, where the commercial entity is or will be incorporated, and how founders will handle governance, dilution, capital calls and cross-border assets. Assess patent rights, software licences, university technology-transfer restrictions, shareholder agreements and foreign-entity conflicts early. Where these matters are complex, obtain specialised Portuguese corporate and tax advice rather than describing programme admission as corporate due diligence.

16 / LEGAL & EVIDENCE REVIEW

Family and post-arrival planning

Founders should assess separate family visa or reunification eligibility, Portuguese housing, costs of living and children’s schooling. The law amended in 2025 imposes a specific reunification framework and exceptions; a founder’s incubator acceptance does not automatically grant a family permit. Corporate tax, employment, VAT, social security, sector licensing and possible establishment obligations also require tailored planning.

17 / LEGAL & EVIDENCE REVIEW

When Startup Visa is the wrong route

A local café, convenience shop, personal consulting agency or conventional trading firm without genuinely innovative, technology-based scalability is unlikely to match the programme’s centre of gravity. A standard D2 entrepreneur or independent-professional route, D1 employment or another lawful category may be more appropriate. We should explicitly decline to package an ordinary business as a fake tech startup.

How Portugal Path should evaluate a founder

Our proposed pre-screen connects founder eligibility, incubator status, novelty and defensibility of the product, unit economics, market evidence, three scenario financial forecasts, recruitment assumptions, personal means, legal ownership and consular/AIMA readiness. Deliverables include a decision memo, an evidence-to-claim matrix, a staged document register, incubator contact protocol and a handoff plan. These are proposed professional service standards, not statements that IAPMEI endorses us or guarantees acceptance.

Illustrative case simulations

The details change the recommendation.

Hypothetical scenarios. They are not case outcomes, client testimonials or guarantees.

SCENARIO 01

Pre-revenue AI startup with evidence

Two founders own working software, have pilot contracts, an IP assignment framework and defensible pricing. They can make a serious incubation application despite limited revenue, if innovation, personal means and commercial growth potential are evidenced. “No revenue” alone does not settle eligibility.

SCENARIO 02

Traditional café labelled a “food-tech platform”

A project intends to operate a café with online reservations but has no meaningful technology innovation or scalable product. Rebranding a retail service as “AI-enabled” is not credible. Screen for an ordinary D2 entrepreneurial route instead of manufacturing Startup Visa assertions.

SCENARIO 03

Four-year-old foreign SaaS corporation

A relocation candidate has operated an overseas SaaS company for four years or longer. The programme’s existing-company limb has a less-than-four-years criterion. Exact incorporation date, ownership, prior-year accounts and planned job creation require checking before seeking incubator interest.

SCENARIO 04

Team of six founders, all seeking residence

Six cofounders are listed, but the programme caps a single application at five candidates. The company may have six founders, but the immigration arrangement cannot simply ignore the application maximum; separate legally sound options and founder roles must be analysed.

Specific answers, not empty questions

Frequently asked questions.

Each answer distinguishes the official rule from the facts and documents needed for an individual assessment.

Is Portugal’s Startup Visa still available in 2026?

Yes. IAPMEI currently publishes an active StartUP Visa programme page and an entrepreneur application route. Incubator certification notices have their own cycles; these must not be mistaken for a blanket closure of all entrepreneur applications.

Is the Startup Visa identical to the D2 entrepreneur visa?

No. It is a specialised IAPMEI and certified-incubator route connected to Article 60(2)(c) and the Article 89(4) permit. Ordinary D2 entrepreneur and independent-professional cases have different evidence and do not require the same technology-incubation assessment.

Does Portugal require €325,000 in my bank account?

No. The €325,000 benchmark is about economic potential: projected annual turnover or assets over the programme horizon. It is not a mandatory cash transfer or a universal company share-capital threshold.

How much personal money must I show in 2026?

Under the published programme rule, own personal financial resources of at least twelve times IAS per candidate. IAPMEI gives 2026 IAS €537.13, yielding €6,445.56. Additional consular subsistence and actual relocation or business costs need separate consideration.

Can I include my partner’s account balance as my own funds?

Do not assume it meets the rule for own means. Evaluate bank ownership, access, transfers and legal source of funds, and ask IAPMEI or the competent authority before relying on third-party funds. Each programme applicant has individual obligations.

Can I apply without incorporating a Portuguese company?

The programme expressly contemplates qualifying projects before company formation. The project must satisfy the innovation/incubator requirements and the applicant must have the capacity to establish the company as the programme develops.

How many co-founders can apply together?

The published normative order caps a programme application at five entrepreneurs. All listed applicants must have an essential contribution and satisfy the relevant personal requirements.

Do I need to live outside Schengen?

The published programme rule excludes permanent residence in the Schengen area. The distinction between citizenship, present legal stay and permanent-residence status matters; assess the actual legal status rather than using geography alone.

Which sectors qualify?

IAPMEI emphasises technology, knowledge, innovation, qualified jobs and internationalisation. Software and deep-tech projects are common fits, but sector labels alone do not qualify or disqualify a project; the substantive innovative business case must be credible.

Can I use any coworking space?

No. The programme requires a currently certified incubator under its framework. A standard coworking contract or an entity accredited for some other innovation scheme cannot be substituted automatically.

How do I get an incubator’s interest?

Select certified incubators suitable for the sector, submit the project information through the IAPMEI system and seek a formal expression of interest. Assess fees, physical availability, mentorship scope and the eventual incubation plan before agreeing.

Is incubator interest enough for the visa?

No. Formal IAPMEI consideration, a positive programme decision, a signed and registered incubation agreement and the required IAPMEI declaration precede the consular stage. Incubator interest is only part of that sequence.

What if my startup already exists abroad?

There are extra relocation criteria, including the less-than-four-years company-age condition, qualifying ownership or executive function, positive prior-year net equity and the potential to create at least five non-founder jobs within 24 months. The precise facts determine this branch.

Does every startup need five employees immediately?

No. The five-job/24-month rule identified in the programme regulation relates to the specific existing-foreign-startup relocation case. Broad potential to create qualified employment is evaluated for programme projects more generally.

Is a €325k revenue target a guaranteed outcome?

No. The programme assesses the credibility of growth potential, not a guaranteed turnover or a promise that a company will reach the target. Sensible downside assumptions should accompany a forecast.

How long does IAPMEI take?

The published normative order provides a programme decision period of up to 30 working days and a further defined period for executing the incubation contract. These are not complete visa or AIMA processing estimates and may depend on procedural circumstances.

Is the incubation contract free?

Do not assume it is. The regulation requires the contract to identify its value, services and obligations; each certified incubator’s commercial terms must be reviewed.

How long does an incubation contract run?

The programme rules describe an initial 12-month incubation contract, renewable by agreement for equal periods while applicable certification conditions continue. The incubation contract and residence permit have different legal durations.

How long is the residence card?

AIMA describes a two-year initial permit under its Startup Visa entrepreneur route, renewable for successive three-year periods when the law and continuing conditions are satisfied. That is different from the initial consular residence visa.

Can my spouse and children come with me?

Possibly through separate accompanying-family or reunification provisions. Rules amended in 2025 introduced waiting periods and exceptions, so family eligibility and filing timing must be considered individually.

What if the business model pivots?

A pivot can affect the evidence of innovation, incubation contract and business commitments. Review reporting and notification duties with the incubator, IAPMEI, AIMA and corporate advisers before assuming that a new activity is covered.

Does the programme give grants automatically?

No. Eligibility for Startup Visa is not a promise of funding, free premises, public grants, bank lending or investor investment. Any incentive programme has independent eligibility criteria.

Do I need to hire a Portuguese lawyer or accountant?

Complex shareholding, tax, IP, employment and regulatory matters may require an appropriately qualified Portuguese lawyer, accountant or sector specialist. Immigration documentation and corporate governance should not be conflated.

Can I enter as a tourist and apply under the old interest declaration?

Do not plan a new entrepreneurial application around the revoked Article 89(2) Manifestação de Interesse route, which AIMA states closed for newly initiated cases from 4 June 2024. Startup Visa has its own dedicated process.

Will the Startup Visa lead automatically to citizenship?

No. A visa or residence permit does not guarantee permanent residence or nationality. Later eligibility depends on residence history and separate laws and requirements in force when applying.

What does Portugal Path examine first?

Before suggesting incubation, we propose a founder and business eligibility audit, independent market and evidence review, personal-means calculation, choice of certified incubators, company relocation screening and a clear milestone plan through IAPMEI, consulate and AIMA. We do not represent these as guaranteed official decisions.

What extra conditions apply if my startup already exists abroad?

The specific existing-foreign-startup branch in the programme regulation includes an enterprise created fewer than four years ago in the country of origin, activity in Portugal, capacity to create at least five jobs excluding founders within 24 months, a founder executive role or at least 10% of capital/voting rights, and positive net equity in the previous financial year. Confirm the consolidated regulatory text and facts before selecting this branch.

Can six co-founders submit one Startup Visa project?

The programme rules provide a limit of five entrepreneurs per application. A six-person team must not assume that six founder visas can be issued under one unchanged application. Review genuinely qualifying roles and possible separate immigration strategies rather than artificially omitting essential founders.

Does an email from an incubator mean IAPMEI has approved my project?

No. Incubator expressions of interest, selection and any binding incubation contract are distinct from IAPMEI’s formal validation and the later consular/AIMA immigration decisions. Verify the incubator’s current certified status and obtain the documents required at each stage.

Does a traditional café qualify as an innovative startup?

Not merely because the applicant uses a digital ordering app or a technology label. IAPMEI evaluates innovation, scalability, international potential, the management team and qualified job creation. A conventional local hospitality business may be better assessed for the ordinary D2 entrepreneur route.

Is the €6,445.56 personal-means benchmark my business investment budget?

No. IAPMEI identifies 12 times the 2026 IAS as personal resources for each founder. A viable project may need separate operational funding, incorporation costs, salaries, intellectual-property work and an incubation budget. This distinction should be evident in the business model and financial evidence.
