What a remote employee should prove when the company paying the salary is outside Portugal
For employees, Portugal’s rule is short: employment contract or employer declaration, three months of qualifying income, and fiscal-residence evidence. The hard part is making the cross-border work arrangement unmistakable. For the route decision that comes before this employee dossier, use the digital nomad temporary-stay vs residence-visa comparison.
An employee’s digital-nomad file can be shorter than a freelancer’s and still be weaker. For the self-employed counterpart, compare digital nomad visa evidence for freelancers.
The reason is usually the employer letter.
A generic HR certificate saying “Alex works for us” proves employment. It may not prove that Alex is allowed to perform that work remotely from Portugal for an employer based outside Portuguese territory.
The best employer letter closes the distance between ‘employed’ and ‘lawfully working remotely from Portugal’.
Portugal digital nomad visa employee: What the law actually requires
Article 31-A gives remote employees a simple legal gateway: employment contract or employer declaration proving the employment relationship.
The same article requires average monthly professional income over the previous three months of at least four Portuguese minimum wages and a document attesting fiscal residence.
In 2026, with RMMG at €920, the route-specific professional-income threshold is €3,680 average per month.
The employer declaration: five lines that matter
| Point | Why it belongs in the letter |
|---|---|
| Employer legal name + registered address outside Portugal | Shows the counterparty is based outside Portuguese territory. |
| Employee name, role and start date | Connects the applicant to a real continuing employment relationship. |
| Salary / compensation structure | Supports the income record and explains payroll credits. |
| Explicit remote-work authorisation | Removes doubt about whether work from Portugal is permitted by the employer. |
| Continuity / expected duration | Shows the relationship is not a one-week arrangement created for the visa. |
Not every consulate publishes that exact five-line template. It is an evidence-quality framework: the statutory declaration proves the labour link, while the file as a whole must also make remote performance for a foreign-based employer credible.
Contract versus declaration
Employment contract
Use it when it is current, readable and already shows the employer entity, salary and remote-work arrangements.
Employer declaration
Use it when the original contract is old, amended many times, silent about remote work, or written in a way that forces a reviewer to reconstruct the current employment relationship from several addenda.
A good declaration can summarise current facts while the contract remains supporting evidence.
Payroll is not the same as the threshold calculation
Payslips help explain gross salary, deductions and recurring employment. Bank statements show what arrived. The visa rule, however, is framed around average monthly professional income earned over the previous three months.
If bonus, commission or equity compensation is part of the package, do not assume it will be treated identically to base cash salary. Show the pay mechanism and focus the core eligibility calculation on amounts that are clear, recurring and evidenced.
Three employee profiles
Profile A — fixed salary above €3,680
Straightforward: contract/employer declaration, payslips and matching bank credits produce a clean three-month record.
Profile B — base salary below threshold + quarterly bonus
The three-month average may still exceed the threshold in a particular period, but the file should explain whether the bonus is contractual, recurring and already earned. A one-off discretionary payment creates more uncertainty than stable base compensation.
Profile C — salary paid in USD or GBP
The employment relationship may be simple while the currency proof is not. Article 24 owns the FX presentation method: preserve original-currency documents, use a transparent conversion reference, and follow any consular-specific conversion instructions. For the conversion workflow, use foreign-currency income evidence for the digital nomad visa.
Employer-of-record and group-company arrangements
Some remote employees work operationally for Brand X but are legally employed by an employer-of-record or another company in the group.
The immigration file should follow the legal employer that signs the contract and pays the salary, while explaining the operational relationship where necessary.
If one entity employs the applicant and another appears on the website, manager letter and salary memo, a one-paragraph corporate explanation can prevent apparent inconsistencies.
What this visa does not settle for the employer
A Portugal residence visa for remote work does not, by itself, decide employer payroll, permanent-establishment, labour-law or social-security obligations.
Those cross-border employer issues depend on facts and applicable law. The visa file should not make unsupported claims such as “the employer has no obligations in Portugal because this is a digital nomad visa.”
Article 19 already separated immigration status from tax residence. The same discipline applies to the employer’s tax/labour position. Once the question becomes Portuguese employment rather than visa evidence, use employment contract types in Portugal and how to read a Portuguese payslip as the separate labour/payroll guides.
The employee dossier in seven documents
Current employment contract.
Employer declaration confirming the labour link and remote-work arrangement.
Three months of payslips/pay statements.
Three months of bank statements showing salary receipts.
A short reconciliation if payroll date and bank-credit date differ.
Foreign-currency conversion sheet if salary is not paid in euro.
Document attesting fiscal residence, in the form required by the competent post.
For an employee, the goal is not document volume. It is alignment: employer, contract, salary and bank record should all describe the same job.
