Portugal does not ask a remote freelancer to look like an employee — it asks for a traceable service business
A freelancer’s strongest remote-work visa file connects clients, contracts, invoices and bank receipts into one understandable three-month income record. Before building the freelancer evidence chain, confirm the principal route in the digital nomad temporary-stay vs residence-visa comparison.
A salaried employee can point to an employment contract and payroll. A freelancer has to prove the same economic reality with different evidence. If a spouse or children are moving with the principal applicant, see digital nomad family planning. For the salaried-employee evidence pattern, compare digital nomad visa evidence for employees.
Portugal’s remote-work residence rules recognise that difference explicitly. Article 31-A accepts, for independent professional activity, a company/society contract, a service contract, or a document demonstrating services provided to one or more entities.
A freelancer does not need to imitate payroll. The file needs to show who you serve, what you do, and what you were actually paid.
Portugal digital nomad visa freelancer: The legal spine of the freelancer file
| Question | Official rule | Evidence architecture |
|---|---|---|
| Are you genuinely self-employed / independent? | One of: society contract, service contract, or document showing services to one or more entities | Client contracts, signed statements of work, corporate/shareholder document where relevant |
| Can the activity be done remotely for entities outside Portugal? | Article 61-B / 31-A remote-work purpose | Contract language, client address, remote-delivery nature of services |
| Do you meet the income threshold? | Average monthly professional income over previous 3 months ≥ 4× RMMG | Invoices + bank credits + statements; tax/accounting evidence where useful |
| Where are you fiscally resident now? | Document attesting fiscal residence | Tax-residence certificate or equivalent evidence accepted by the post |
The three-month evidence chain
The law focuses on the average monthly income earned from the professional activity during the previous three months. That makes the best freelancer file chronological.
Month 1
Client A invoice → bank receipt. Client B invoice → bank receipt. Keep the contract or statement of work that explains the recurring relationship.
Month 2
Repeat the same logic. If a client paid late, do not hide the mismatch: show the invoice date, payment date and bank credit.
Month 3
Close the three-month period and calculate the professional-income average. If you have multiple currencies, Article 24 explains how to present the conversion transparently without pretending there is one universal consular FX formula.
A freelancer with one large client
One-client freelancers are not automatically disqualified. The law expressly allows services to one or more entities.
The risk is evidential concentration: if 90% of income comes from one client, the contract should be particularly clear about service scope, fee, duration and remote performance.
If the relationship looks indistinguishable from employment, that can have tax/labour classification consequences in the relevant jurisdictions. The immigration file should describe the real relationship rather than forcing it into the word “freelance”.
A freelancer with six small clients
The opposite problem is document sprawl.
Do not submit 80 pages of invoices with no map. Build a one-page revenue index that shows client, invoice, currency, gross amount, payment date and statement page.
| Client | Invoice / period | Amount | Bank evidence |
|---|---|---|---|
| Client A | Aug retainer | USD X | Statement p. 2 — credit dated … |
| Client B | Project milestone | EUR Y | Statement p. 3 — credit dated … |
| Client C | Monthly services | GBP Z | Statement p. 4 — credit dated … |
The index is not evidence by itself. It is a navigation layer that makes the primary evidence usable.
What counts as income for the threshold?
The regulation says professional income earned in the exercise of subordinate or independent activity. That is narrower than “net worth”.
Savings can matter elsewhere in the visa file, but a large savings account is not the same thing as showing the required average professional income over the last three months.
Likewise, an unpaid invoice may show future receivables but not necessarily income already earned/received in the same evidential sense as settled client work. Where the distinction matters, use contracts, invoices and bank records together.
The tax-residence document is not your NIF
Article 31-A requires a document attesting the applicant’s fiscal residence.
A Portuguese NIF obtained as a non-resident is not automatically evidence that Portugal was your tax residence before the move. Use the tax-residence certificate or equivalent documentation required by the competent consular post.
Common freelancer weaknesses
Invoices with no bank trail.
Bank deposits with no client/invoice mapping.
Client contracts that never say what service is being performed.
A portfolio or website used as a substitute for contractual evidence.
Three-month income calculated from gross invoices that were never paid, with no explanation.
Personal transfers between the applicant’s own accounts counted again as professional income.
A Portuguese client presented as the main remote-income source even though the route is designed for activity provided to persons/entities outside Portuguese territory.
The final freelancer audit
List every income-producing client in the three-month test period.
Attach the contract/service evidence that explains each relationship.
Match invoices to incoming bank credits.
Remove internal transfers from the professional-income calculation.
Convert foreign-currency income consistently and transparently.
Calculate the three-month average and compare it with the current 4×RMMG threshold.
Add the fiscal-residence evidence required by your post.
Make remote performance and foreign client/entity location obvious.
A freelancer file is strongest when the reviewer can trace the business from contract → work → invoice → money without guessing. After relocation, Portuguese activity setup is a separate question: use the Recibos Verdes setup guide for opening/operating the activity and the self-employed Social Security guide for contribution duties.
