How Much Time Must a Startup Visa Founder Actually Spend in Portugal?

There is no Golden Visa-style “7-day rule” — but there are three different presence obligations founders should not confuse

Startup Visa combines physical incubation, ordinary temporary-residence absence rules and real business execution. None of those is accurately summarised as “you only need to be in Portugal X days per year.”

Founders often ask the presence question as though every Portuguese residence route has a neat annual day count.

Startup Visa does not work like the ARI/Golden Visa minimum-stay regime.

There are instead three clocks: the incubation model, the residence-permit absence rules, and the commercial reality of building the company in Portugal. For the institutional deadline sequence that runs alongside these presence obligations, use Portugal Startup Visa residence permit validity.

The absence of a seven-day minimum does not mean the programme was designed for a founder who never really lives or incubates in Portugal.

Portugal Startup Visa physical presence: Clock 1 — the incubation contract is physically based

IAPMEI’s published Startup Visa FAQ states that the incubation contract must follow a physical incubation model and excludes virtual incubation under the certified-incubator rules.

The same framework requires certified incubators to have the capacity and availability to physically incubate entrepreneurs hosted under Startup Visa.

That does not publish a universal attendance sheet saying “five days a week at the desk”. It does tell you that a purely virtual relationship is not the model the programme describes.

Clock 2 — ordinary temporary-residence absence rules

Once the founder holds a Portuguese temporary residence permit, Article 85 of the immigration law becomes important.

SituationCurrent legal thresholdWhat it means
Temporary residence permitPossible cancellation for absence of 6 consecutive months or 8 non-consecutive months during the permit’s total validity, without acceptable reasons.A founder should not plan indefinite residence abroad.
Absence above those limitsCan be justified to AIMA before departure, or exceptionally after departure.Long absences need to be managed, not ignored.
Professional/business/cultural/social activity abroadThe law provides that residence is not cancelled for excess absence where the person proves qualifying activity during the absence. This is an exception based on evidence, not a blanket remote-founder rule.

The consolidated Article 85 is the source to read. It is more useful than comparing Startup Visa to Golden Visa, because Golden Visa has a special minimum-stay regime that does not automatically transfer to ordinary entrepreneur residence.

Clock 3 — the company must actually be incubated and built

Startup Visa exists to host entrepreneurs who develop an innovative project and establish business activity in Portugal. IAPMEI’s FAQ states that the Portuguese company should be set up during the incubation contract and be established by its end.

A founder who spends most of the residence period elsewhere therefore has two separate questions to answer: is the residence legally maintainable, and is the Startup Visa project being executed consistently with the programme?

Three calendars

Calendar A: the Portugal-based operator

One founder relocates to Lisbon, attends incubation meetings, leads pilots and manages the Portuguese company. Travel abroad is ordinary business travel. This is the easiest presence story to understand.

Calendar B: the international-sales founder

A founder may spend significant periods abroad selling, fundraising or managing international pilots. Article 85 expressly recognises professional/business activity as relevant when absence exceeds normal limits, but the evidence matters: contracts, meetings, projects, travel and continuing Portuguese business ties.

This is where advance advice may be useful if the absence could cross statutory thresholds.

Calendar C: the nominal founder who remains abroad

The project is approved, but the founder never really relocates, uses incubation only on paper and delegates all activity to others. Even before reaching a precise absence threshold, that pattern is difficult to reconcile with a programme based on physical incubation and individual essential founder contribution.

Tax residence is a separate question

Immigration residence and tax residence are not synonyms.

Portugal’s tax-residence rules can depend on days of presence and having a dwelling showing an intention to occupy it as habitual residence. A founder may therefore have an immigration title and a tax analysis that depends on different facts.

Use the Portuguese Tax Authority information on residence for the current tax framework. Do not infer tax residence merely from holding a Startup Visa card. For the founder-specific version of that analysis, see tax residence for Startup Visa founders in Portugal.

What physical incubation should change in your planning

  • Ask the incubator what physical presence and workspace use the contract actually expects.

  • Build travel around programme milestones rather than assuming incubation is virtual.

  • Keep evidence of Portugal-based project activity: pilots, meetings, office use, hires, customers and company operations.

  • If an extended business absence is foreseeable, assess Article 85 before crossing the normal thresholds.

  • Treat tax residence, social-security and company-management substance as separate professional questions.

The practical answer to “how many days?”

There is no official Startup Visa rule equivalent to the Golden Visa’s published seven-day/14-day minimum-stay schedule.

The safer answer is more demanding: live the residence as an ordinary temporary resident, respect Article 85 absence rules, comply with physical incubation, and make the project’s Portuguese execution real enough to be evidenced.

A founder should optimise the business calendar around the company — not around the smallest number of days that can be defended after the fact. This presence analysis is separate from the money test; use Portugal Startup Visa financial requirements for the founder-funds question.
